Nvidia sued by Jamendo over AI music copyright infringement

Belgian music platform Jamendo, owned by the Winamp Group, has filed lawsuits against Nvidia in both the United States and Belgium. The complaints allege that Nvidia trained its Fugatto and Audio Flamingo generative‑AI models on roughly 55,600 tracks from Jamendo’s catalogue and the MTG‑Jamendo dataset without securing a commercial licence. Jamendo says the data were made available only for non‑commercial research, and that Nvidia’s use constitutes copyright infringement, breach of contract, unjust enrichment and unfair competition.

The U.S. case was lodged in a California federal court, while a parallel proceeding continues in Ghent, Belgium, where a judge rejected Nvidia Belgium’s objection to jurisdiction. Jamendo seeks at least €17.8 million (about $20.3 million) in damages, based on an invoice of €289 per track for the alleged unauthorized use. Nvidia has not responded to requests for comment.
