AI music copyright and publicity lawsuits expand

Overview

Since June 2026, AI music generators have faced a wave of copyright actions. Belgian platform Jamendo sued Nvidia, while Sony Music, Universal, and Warner Music Group sued Udio for copying more than 30,000 recordings. In July, Sony filed a complaint in the Southern District of New York seeking damages of up to $150,000 per work. Thousands of independent musicians also joined class-action suits against Udio and Suno. On July 31, the Munich Regional Court ruled that Suno infringed copyright by using six protected songs for training without a license. This was reinforced on 10 August by a Munich ruling in favor of the German rights organization GEMA, which determined Suno violated both German and American copyright laws. Nicky Trebbien of Koda described the ruling as a “historic decision” signaling that AI companies cannot build businesses on the work of others without respect for copyright. In response to legal pressures and a settlement with Warner Music Group, Suno implemented changes including audio watermarking and updated community guidelines. On 12 August, Suno entered a global licensing agreement with BMG to use recorded and publishing works for training, provided artists opt in for compensation; this deal also settled Suno’s past use of BMG material. Simultaneously, the company launched Suno Studio 2.0, a generative audio workstation upgrade. However, litigation continues to expand. On 17 August, Round Hill Music filed a lawsuit in the Northern District of California against Suno and Anthropic, alleging the unauthorized ingestion of lyrics and compositions from at least 500 songs, with plans to potentially seek damages exceeding $1 billion. On 1 September, musicians led by Jason Isbell filed a proposed class-action lawsuit in a Massachusetts federal court. This suit shifts focus toward rights of publicity and biometric privacy, alleging Suno misappropriates artist identities and captures ‘voiceprints’ during training.
