Odair Moniz family appeals suspended sentence of PSP officer
The family of Odair Moniz has filed an appeal with the Lisbon Court of Appeal regarding the sentence handed to PSP officer Bruno Pinto. Moniz was shot and killed by the officer in October 2024 in the Cova da Moura neighborhood of Amadora.
In the initial ruling, Pinto was sentenced to three years and six months of prison, a sentence that was suspended. The family’s legal defense argues that the verdict contains “insuperable contradictions,” claiming the court recognized facts that undermined the necessity of using a firearm, yet still concluded there was self-defense with excess.
The appeal seeks a more severe sentence, requesting effective prison time of between eight and sixteen years based on the charge of simple homicide with direct intent. Additionally, the family is calling for the officer’s dismissal from the PSP and an increase in compensation for non-patrimonial damages and the loss of life.
The Public Ministry has also appealed, arguing that the officer acted with direct intent to kill, thereby rejecting the self-defense theory. While the officer has since returned to administrative duties at the Setúbal District Command following the revocation of his suspension, the legal battle over the proportionality of the sentence continues.
