Omgevingswet complicates environmental enforcement in the Netherlands
The Council for the Environment and Infrastructure (Rli) has issued an advisory to the Dutch government warning that the Omgevingswet (Environment Act) is complicating environmental supervision and enforcement.
According to the Rli, enforcers have lost oversight and guidance due to the law's structure. The shift from a permit-based system to one centered on general rules means that violations and nuisances are often only identified after they have occurred, necessitating retroactive corrections. This process has reportedly increased administrative workloads, forcing inspectors to spend more time at desks and less time conducting on-site inspections, which allows some violations to remain undetected.
The Rli has called on Minister Elanor Boekholt-O'Sullivan to develop plans to improve the law's practical functionality. Recommendations include establishing mandatory agreements between authorities, municipalities, and the business community regarding the specific data required for applications to reduce uncertainty and frustration.
