Pacific Lifestyle Properties ordered to demolish towers in Nayarit
A Mexican administrative court has upheld sanctions against Pacific Lifestyle Properties, ordering the demolition of two towers at the Punta Paraíso condominium in San Pancho, Nayarit. The ruling follows a six-year legal battle regarding irregular constructions on land reclaimed from the sea within the Federal Maritime-Terrestrial Zone.
The Twelfth Collegiate Court in Administrative Matters unanimously denied the real estate company’s request for protection, confirming the decision of the Federal Tribunal of Administrative Justice. As part of the sanctions, the company must demolish the structures and restore 1,466.008 square meters of reclaimed land to its original state. Additionally, the company is required to pay a fine of 96,220 pesos.
The legal dispute stems from a violation of federal concessions. While Semarnat originally granted a concession in 2009 for the area to be maintained in a natural state, a 2014 modification allowed for recreational use, which did not permit the type of construction identified by Profepa. The court's decision establishes that the identified buildings, referred to as “Torre 1” and “Torre 2,” will be forfeited to the Nation.
