Penticton unhoused encampment ordered to be cleared by B.C. court
A British Columbia Justice has issued an injunction ordering the clearance of an unhoused encampment located off Highway 97 in Penticton. The Fairview Encampment, which has existed for approximately two years, consists of a fenced community of tents and temporary structures built on a road dedication.
Justice Briana Hardwick ruled that the encampment presents a “significant ongoing public safety risk” and noted that the road dedication is unsuitable for such use. The court specifically highlighted documented fire risks as being “particularly dangerous.”
The injunction, which requires all residents to vacate and all temporary structures to be removed, is set to take effect at noon on October 30. In her findings, Justice Hardwick stated that the order does not violate residents' rights under Section 7 of the Charter, noting that the proximity to the busy intersection of Highway 97 and Fairview Road makes the location unsuitable for camping.
