Penticton Fairview encampment eviction

Overview

A British Columbia Justice issued an injunction ordering the clearance of the Fairview Encampment, a community of tents and temporary structures located off Highway 97 in Penticton. Justice Briana Hardwick ruled that the site presents a “significant ongoing public safety risk,” specifically citing documented fire risks as being “particularly dangerous.” The order requires all residents to vacate and all structures to be removed by noon on October 30.

Following the ruling, the City of Penticton clarified that the province is responsible for all decampment and remediation efforts, as the land is a road dedication held by the Ministry of Transportation and Transit. The city noted that while limited overnight sheltering is permitted within city limits, certain areas such as lakeshores, parks, and environmentally sensitive locations remain prohibited under city bylaws.

On October 30, authorities began clearing the encampment at the intersection of Fairview Road and Highway 97. While more than 20 people were initially estimated to be living at the site, the City of Penticton reported that approximately 11 people remained before the injunction took effect. The city has coordinated with community partners to provide emergency shelter space and outreach workers to assist displaced individuals in connecting with housing and support services.
