Peru proposes new mining law to formalize small-scale operators

The Peruvian government has introduced a new Small-Scale Mining and Artisanal Mining Law (Ley MAPE) aimed at restructuring the sector and transitioning miners away from the Integral Mining Formalization Registry (Reinfo). Under the proposal, the Reinfo would be closed to new registrants, and current participants would have an 18-month window between January 2027 and June 2028 to complete their formalization processes.

The initiative seeks to simplify administrative procedures and establish a specialized entity to centralize management and improve mineral traceability. Paul Vera Regalado, Director General of Mining Formalization at the Ministry of Energy and Mines (MINEM), stated that the law is designed to reflect territorial realities and provide technical support to ensure sustainable mining practices.

However, experts have raised concerns regarding the law's effectiveness. While some view it as a necessary starting point for discussion, others warn that success depends on the state's ability to increase oversight and address structural obstacles that prevent producers from entering the formal economy. The debate centers on whether the new law can effectively distinguish between legitimate small-scale miners and illegal operations.
