Peru small-scale mining formalization reforms
Overview
The Peruvian Ministry of Energy and Mines, led by Minister Guillermo Shinno, has formally presented the Small-scale and Artisanal Mining Law (Ley MAPE). This proposal seeks to replace fragmented regulations with a permanent legal framework. Under the plan, the Integral Mining Formalization Registry (Reinfo) is scheduled to conclude on December 31, 2026. This would be followed by a consolidation regime from January 1, 2027, until December 31, 2028, allowing currently registered miners to continue operations until June 30, 2028. The legislation includes the creation of the National Agency for the Strengthening of Artisanal and Small-scale Mining (FORMAPE) to oversee operational standards, safety, and technological innovation. While formalization could potentially add 1.5% to Peru's GDP and create up to 400,000 jobs, the proposal faces significant scrutiny. The Illegal Mining Observatory (OMI) has criticized the consolidation regime, suggesting it might function as a “covert” extension of Reinfo without sufficient guarantees for environmental or labor oversight by entities like OEFA and Sunafil. Adding to the tension, the Institute of Mining Engineers of Peru (IIMP) has warned that delays in approving the Ley MAPE could be used as a pretext to extend Reinfo. Gustavo De Vinatea of the IIMP emphasized that the approval of the new law is not a legal prerequisite for ending the registry, noting that existing frameworks already allow for formalization processes. He cautioned against strategies intended to stall legislative debate to justify further extensions of a mechanism that has been in effect for 14 years. Paul Vera Regalado, Director General of Mining Formalization at the Ministry of Energy and Mines (MINEM), stated that the law is designed to “reflect territorial realities and provide technical support to ensure sustainable mining practices.” The initiative aims to simplify administrative procedures and establish a specialized entity to centralize management and improve mineral traceability.
