Peru proposes new mining regime to formalize small-scale miners
The Peruvian Ministry of Energy and Mines has proposed the Artisanal and Small-Scale Mining (MAPE) Law, which includes a new consolidation regime. Under this proposal, miners currently registered in the Integral Mining Formalization Registry (Reinfo) could continue operations until June 30, 2028. This transition period would begin on January 1, 2027, extending beyond the current Reinfo closing date of December 31, 2026.
The initiative aims to provide a gradual procedure for formalization and includes the creation of the National Organism for the Strengthening of Artisanal and Small-Scale Mining (FORMAPE). However, the Illegal Mining Observatory (OMI) has criticized the measure, suggesting it may act as a covert extension of the Reinfo without providing clear guarantees for environmental oversight or fiscalization by entities such as OEFA and Sunafil.
Separately, in Colombia, the Fifth Commission of the House of Representatives approved two legislative projects. One seeks to facilitate the formalization of subsistence and small-scale mining through a National Technical, Legal, and Social Assistance Program. The second aims to improve food traceability by creating the “Directo del Campo” National Registry for Fresh Food Marketers.
