Jinggoy Estrada's Participation Dispute in VP Sara Duterte Impeachment

Senator Jinggoy Estrada, currently detained on plunder and graft charges linked to a flood‑control fund scandal, maintains that he remains a senator‑judge for Vice President Sara Duterte’s impeachment trial. He told reporters that any claim he has been stripped of his authority is “premature, baseless, and undermines the integrity of the impeachment process itself.”

The House prosecution panel has filed a motion to disqualify Estrada, arguing that his detention and pending cases raise questions about impartiality. Representatives such as Joel Chua asked, “How can someone cast a vote without having participated in the impeachment trial?” The Senate impeachment court has not yet ruled on the motion.

Legal scholars are debating whether Estrada’s suspension should affect the voting threshold needed to convict the vice president. While the Constitution requires a two‑thirds majority (16 of 24 senators), some, including former Supreme Court justice Antonio Carpio, contend that suspended or detained senators cannot vote, potentially lowering the required number of votes. Others argue the conventional view should stand until the Senate decides otherwise.
