Philippines Senate debates vote threshold for VP Duterte impeachment
Former Senate President Franklin Drilon said the requirement of 16 votes to convict Vice President Sara Duterte in the upcoming impeachment trial is not fixed and may be decided by the Supreme Court. He cited legal questions about whether absent or detained senators count toward the two‑thirds majority.
Legal analysts are divided. Retired Justice Adolfo Azcuna argues the Constitution mandates a rigid 16‑vote threshold based on the full 24‑member Senate, unless a senator such as Ronald Dela Rosa is deemed to have resigned, which would lower the quota to 15. Former Justice Antonio Carpio contends the threshold could fall below 16 depending on how many senators are able to vote, pointing to the detention of Jinggoy Estrada and the ICC warrant against Dela Rosa as factors that may reduce the voting pool. The impeachment trial is scheduled to begin on 6 July.
