Poland begins transcription of foreign same-sex marriage certificates

Poland has implemented new procedures allowing civil registry offices to transcribe foreign same-sex marriage certificates. This change, effective as of late August, enables the formal recognition of unions legally contracted outside of Poland.

Following these administrative updates, the Social Insurance Institution (ZUS) has begun issuing the first benefits to same-sex couples, such as caregiver allowances. The government is currently exploring further legal equality, including discussions with the Ministry of Finance and the National Revenue Administration regarding tax rights, joint tax filing, and inheritance and gift taxation rules.

These regulatory shifts follow judicial developments, specifically a ruling by the Court of Justice of the European Union which determined that EU member states cannot deny recognition of legally contracted same-sex marriages from other member states if doing so violates the right to free movement of citizens. The new document templates were developed by the Ministry of Digital Affairs and the Ministry of the Interior and Administration.
