Poland labor law: Deadline for unused annual leave

In Poland, employees face a critical deadline regarding unused annual leave. According to the Labor Code, any leave remaining from the previous calendar year must be utilized by September 30 of the following year. If employees have not submitted requests for this overdue leave, employers have the legal authority to schedule it themselves to avoid committing a labor law violation, which can result in fines ranging from 1,000 to 30,000 PLN.

Regarding leave types, ‘leave on demand’ (urlop na żądanie) is a paid benefit that draws from an employee's standard annual leave pool, not an additional allotment. Employees are entitled to up to four such days per calendar year.

Psychological experts emphasize that proper vacation planning is essential for mental health and preventing burnout. Experts suggest a combination of one longer trip, such as two weeks, and several shorter breaks of three to four days to effectively replenish mental and physical resources.
