Poland expands silent‑consent rule to 17 statutes, changing administrative process

A law adopted on 11 June 2026 broadens the use of the “silent‑consent” mechanism to 17 different statutes, including tax arrears, agricultural tax relief, road‑transport permits, mass‑event organization, payment‑institution registers and waste‑collection licences. Under the new rule, if an authority fails to issue a decision within the statutory deadline, the request is deemed positively resolved from December 2026, effectively shortening administrative proceedings and forcing agencies to act within set timeframes.

At the same time, the 1990 Municipal Self‑Government Act (art. 101) clarifies that only parties whose legal interest is directly infringed by a municipal resolution may challenge it in administrative court. A complainant must demonstrate a concrete, individual legal interest, and cannot appeal a decision that has already been dismissed by a court.

Together, these reforms aim to increase procedural efficiency and ensure that only directly affected individuals can contest local government actions.
