Polish legal dispute over same-sex marriage transcription

New executive regulations in Poland have introduced document templates to allow for the transcription of foreign same-sex marriages into the Polish legal system. This development has sparked intense political debate.

Members of The Left view the regulation as a step toward equality, while members of Law and Justice and the Confederation argue it undermines the Polish Constitution and disregards previous Constitutional Tribunal rulings. Local officials have expressed concern that the regulations do not resolve the fundamental legal conflict between the government, parliament, and the Constitutional Tribunal, which may result in inconsistent application across different municipalities.

As of August 23, 2026, the Ministry of Digital Affairs has implemented administrative rules allowing same-sex couples married abroad to have their marriages officially recorded in the national civil registry. This includes marriages from outside the European Union, provided they meet specific documentation and legalization requirements. This shift follows a landmark judgment by the Court of Justice of the European Union, which ruled that Poland could not refuse to recognize marriages performed in other EU member states, as doing so interfered with “freedom of movement and the right to family life.”

While the reform allows for the transcription of existing foreign marriages, same-sex marriage remains prohibited within Poland. Domestic legislative efforts to expand rights continue to face hurdles; President Karol Nawrocki recently vetoed bills that would have permitted same-sex couples to enter into cohabitation contracts regarding medical information, property, and burial rights. The legal landscape remains complex due to ongoing tension between Polish domestic law and EU judicial decisions.
