Poland faces EU risks over delayed pay equity directive implementation

Poland has failed to meet the June 7, 2026, deadline for implementing the European Union's pay equity directive. Despite the lack of domestic legislation, legal experts suggest that employees may already be able to exercise rights granted by the directive.

Gniewomir Wycichowski-Kuchta, a legislation expert from the University of Warsaw, notes that workers can request information regarding their individual compensation levels and average salary scales within their companies. If employers refuse to provide this data, employees may have grounds to pursue their rights through the court system.

The delay poses risks for the Polish state. The European Commission may initiate infringement procedures, starting with informal dialogue via the EU Pilot program. Failure to resolve the issue could lead to formal proceedings and eventual litigation before the Court of Justice of the European Union, potentially resulting in financial penalties.
