Poland faces legal disputes over same-sex marriage transcriptions

Legal disputes have emerged in Poland regarding the transcription of same-sex marriages performed abroad into Polish civil registries. Following a regulation by the Ministry of Digital Affairs on August 23, which was prompted by decisions from the Court of Justice of the European Union and the Supreme Administrative Court, civil registry offices have begun processing these requests.

In Gdańsk, activists from Młodzież Wszechpolska and Konfederacja have filed a complaint with the Provincial Administrative Court. They argue that the transcription of same-sex marriages is unconstitutional. Conversely, Deputy Minister of Digital Affairs Dariusz Standerski stated there is no legal basis to refuse these requests if the document is valid in another EU member state.

In Zakopane, the Civil Registry Office refused a transcription request, leading to an appeal process. The Mayor of Zakopane, Łukasz Filipowicz, noted that local legal opinions suggest transcription contradicts Polish law, citing a conflict between government guidelines and Constitutional Tribunal rulings. He stated the municipality intends to uphold the traditional family model favored by the region's majority.
