Poland implements new tax rights for same-sex couples and investment laws

Poland is seeing significant legislative and administrative shifts regarding taxation and social rights. Finance Minister Andrzej Domański has signed a general tax interpretation that grants same-sex couples, who have transcribed foreign marriage certificates in Poland, the same tax rights and obligations as other married couples. This decision follows a CJEU ruling and aims to ensure equality in tax benefits and social security, such as care allowances. The move has faced criticism from the Presidential Cabinet, which argues it is an unconstitutional attempt to equate marriage with same-sex unions without proper legislative debate.

In separate developments, President Karol Nawrocki has signed the law establishing Personal Investment Accounts (OKI). Set to launch on January 1, 2027, the system offers tax-preferential treatment for voluntary investments, including an exemption for assets up to 100,000 PLN.

Additionally, the Senate has passed a windfall tax bill targeting extraordinary profits from liquid fuel companies. The proposed 60 percent tax on excess margins is intended to fund programs to lower fuel prices for consumers.
