Poland implements new rules for transcribing foreign same-sex marriages
New regulations from the Polish Ministry of Digital Affairs entered into force on August 23, enabling the transcription of foreign same-sex marriage certificates into the Polish civil registry. The change introduces three document templates to accommodate different spouse gender combinations, replacing previous forms that only recognized man and woman. This administrative shift follows rulings from the Court of Justice of the European Union and the Supreme Administrative Court.
The implementation has triggered significant tension between the central government and local authorities. While Deputy Prime Minister and Minister of Digital Affairs Krzysztof Gawkowski noted that the first transcriptions were completed on the morning of implementation, several local leaders have declared their opposition. The Mayor of Zakopane, Łukasz Filipowicz, and the Mayor of Jordanów, Andrzej Malczewski, have both stated they will not facilitate these transcriptions, citing traditional definitions of marriage.
Critics, including members of the PiS party and the Ordo Iuris Institute, argue that the new regulations are unconstitutional. They contend that the measures conflict with Article 18 of the Polish Constitution, which they interpret as defining marriage exclusively as a union between a man and a woman. Government Equality Plenipotentiary Katarzyna Kotula has warned that refusing to perform these transcriptions constitutes a violation of the law.
