Poland: Private vehicles can be requisitioned for military use
Under the Defense Act in Poland, private vehicles can be temporarily requisitioned for state defense needs, even during peacetime. This process requires a formal administrative decision from local authorities, such as a mayor or city president, followed by a specific summons to the owner.
For peacetime mobilization readiness checks, vehicles may be required for up to 48 hours, while military exercises may require use for up to 7 days. Such obligations can be imposed on individuals up to three times per year.
A recent draft regulation regarding transport requisition during wartime has updated the names of military bodies mentioned in 2004 legislation but does not create new rights to seize private property. Owners have 14 days to appeal an initial administrative decision to the voivode, though once a summons is issued following a final decision, it cannot be appealed.
