Poland property laws regarding tree removal and neighbor access
Legal guidelines in Poland outline specific requirements for tree removal and property access. For tree removal on private plots, the necessity of a permit or notification depends on the species and the trunk circumference measured at a height of 5 cm. If the circumference is below a certain limit, no formalities are required. For trees exceeding this limit, individuals not conducting business must submit a notification to the authorities, which includes property details and a location map. The administration has 21 days to inspect and 14 days to object. To minimize impact on wildlife, the safest period for removal is between October 16 and the end of February.
Regarding property boundaries, the installation of a gate in a fence does not grant a legal right to enter a neighbor's property. Under the Civil Code, a gate leading directly onto a neighbor's land requires explicit consent or a legal easement. Unauthorized entry or interference with a boundary fence can lead to civil claims or criminal liability if property is damaged. Property owners maintain the right to decide who enters their land, regardless of whether a gate provides a shorter route to public amenities.
