Overview
Polish regulations address the management of vegetation and trees in relation to property boundaries and land use.
Under the Civil Code, plants and fruits near boundaries are subject to specific rules. Trees may be planted on boundary lines for joint use, and fruit ownership is determined by the location of the tree trunk, though fruit falling naturally onto a neighbor’s land may be collected by that neighbor. Maintenance rules allow neighbors to remove encroaching roots without notice, while overhanging branches require a prior request to the owner.
Regarding tree removal, the Nature Conservation Act mandates specific notification or permit requirements based on species and trunk circumference. Certain species, such as poplars or willows, have different circumference thresholds for exemption from notification. While farmers may remove vegetation to reclaim uncultivated agricultural land without a permit, these exemptions do not apply to trees located on borders, roadsides, or riverbanks. Non-compliance with these regulations can lead to administrative fines.
