Poland Sejm passes law for night-time alcohol ban and advertising restrictions

The Polish Sejm has passed a new law introducing significant restrictions on alcohol sales and advertising, set to take effect on January 1, 2027, pending Senate approval and presidential signature. The legislation mandates a nationwide prohibition on off-site alcohol sales, such as in shops and gas stations, between 22:00 and 06:00. However, establishments like restaurants, bars, and hotels will be exempt, allowing alcohol consumption on-site.

Local municipalities are granted the authority to implement even stricter hours, potentially extending the ban to periods such as 21:00–22:00 or 06:00–09:00. The law also imposes a total ban on the advertising and promotion of all alcoholic beverages, including beer, and prohibits volume-based promotions like “6+6” deals. Violators of advertising restrictions face fines between 30,000 PLN and 1 million PLN or restriction of liberty.

Additional measures include mandatory age verification by sellers and requirements for small-capacity containers (up to 300 ml) to be made exclusively of glass or metal. The industry has expressed mixed reactions; while some support the goal of reducing excessive consumption, brewers have raised concerns regarding the advertising ban on non-alcoholic beers. Meanwhile, political groups like PiS are proposing further restrictions on small-format, high-proof alcohol containers, known as “małpki.”
