Poland alcohol advertising and sales ban debate

Overview

By late August 2026, legislative efforts in the Sejm moved toward a nationwide statutory restriction on nighttime alcohol sales to replace the current patchwork of local regulations. A compromise has emerged regarding fuel stations: while earlier drafts sought a total ban, the current version allows daytime sales but mandates a nationwide prohibition between 22:00 and 06:00. If passed, these regulations could take effect on January 1, 2027.

Local implementation is already advancing. In Zielona Góra, a resolution was passed to restrict alcohol sales intended for off-site consumption at shops and gas stations between 22:00 and 06:00, effective October 1, 2026. In Gliwice, authorities launched public consultations running through mid-September to consider similar restrictions. Meanwhile, Kraków implemented extended nighttime bans on September 1, prohibiting retailers, including supermarkets and discount stores, from selling alcohol for off-site consumption during late-night hours.

In Włodawa, a new proposal by councilman Krzysztof Steć suggests limiting nighttime sales for off-site consumption to improve public safety and reduce vandalism. However, Mayor Wiesław Muszyński has urged caution, stating that any regulation restricting business must be preceded by a thorough analysis of social and economic impacts on local entrepreneurs.

At the national level, political consensus is growing around banning small, high-proof alcohol containers (under 200 ml), known as ‘małpki’. Additionally, debates have expanded to include advertising restrictions. Legal expert Krzysztof Koźmiński argues that restricting beer advertising is a “calculated health policy cost,” despite concerns that sports clubs could lose approximately 100 million PLN annually in sponsorship revenue.
