Poland updates real estate and building regulations

Poland is implementing significant changes to its construction and real estate regulations. As of September 1, the housing special act, commonly known as ‘lex deweloper’, has expired after eight years of operation. This law allowed municipal councils to approve residential investments even if local spatial management plans did not originally designate the area for housing. While ongoing proceedings are unaffected, new investments must now follow the integrated investment plan model. The Polish Association of Developers estimates that approximately 100,000 apartments were built under the previous special act.

Additionally, an amendment to the Building Law has extended the period during which current technical conditions for buildings and objects can be applied. Investors and contractors will have an additional 18 months to utilize existing technical standards for installations such as photovoltaics, energy storage, and heat pumps. This transitional period aims to facilitate ongoing investments and reduce the risk of having to adjust technical documentation to new requirements in the short term.
