Poland residential building and real estate regulation

The Polish Ministry of Finance and Economy is developing a reform of technical building regulations to replace standards dating back to 2002. The proposed draft covers the design, construction, reconstruction, and placement of buildings, alongside rules for residential property use.

Key components of the reform include updated fire safety and energy efficiency standards, improved accessibility for people with special needs, and enhanced acoustic protections to minimize noise transfer between apartments. For multi-family buildings with three or more floors, the project mandates the installation of accessible passenger or service elevators.

As of September 1, 2026, significant shifts in the regulatory landscape have occurred. The housing special act, known as ‘lex deweloper’, has expired after eight years. While ongoing proceedings remain unaffected, new investments must now follow an integrated investment plan model.

Furthermore, an amendment to the Building Law has extended the period for applying current technical conditions. Investors and contractors now have an additional 18 months to utilize existing standards for installations such as heat pumps, energy storage, and photovoltaics. This transitional period is intended to facilitate ongoing investments and mitigate the risk of immediate technical documentation adjustments.

The technical building regulation reform remains in the legislative process and has not been officially published in the Journal of Laws. While the legislative schedule suggests a potential implementation date around September 20, 2026, the final wording and transitional provisions remain unconfirmed.
