Poland's Finance Minister grants tax parity to same-sex spouses

The Polish Minister of Finance, Andrzej Domański, has issued a general interpretation aimed at granting same-sex spouses the same tax rights and obligations as other married couples, provided their foreign marriage certificates have been transcribed into the Polish civil registry.

This move follows a specific ruling by the Director of the National Tax Information (KIS), which had previously determined that a foreign same-sex marriage alone does not grant the right to tax exemptions for the closest family group. The taxpayer in that case had argued that the transcription of a marriage certificate is merely a technical formality and that the legal status of a spouse should be based on the objective existence of a valid marriage.

The new general interpretation by the Ministry of Finance seeks to ensure uniform application of tax laws. While the decision provides immediate tax parity for couples with transcribed marriages, it faces potential opposition from conservative political figures who may seek to challenge its validity.
