Polish labor law requirements for employment certificates
Under Polish labor regulations, employers have an absolute obligation to issue an employment certificate to an employee upon the termination of their employment relationship. This requirement applies to both fixed-term and indefinite-term contracts. Ideally, the document should be handed over on the final day of employment. In certain objective circumstances, employers may mail the certificate to the employee's last known address within seven days of termination.
Failure to comply with these regulations can lead to legal consequences. Employees have the right to sue for the issuance of the certificate and may seek damages if the employer's failure to provide the document or providing one with errors results in financial loss, such as preventing the employee from starting a new job.
