Polish property law rules on boundary plants and fruit

Under the Polish Civil Code, specific regulations govern the management of plants and fruits located near property boundaries. There are no universal minimum distances required for planting trees or shrubs; they may even be planted directly on the boundary line to be used jointly by neighbors.

Regarding fruit ownership, items remaining on the branches belong to the owner of the property where the tree trunk is located, even if branches overhang a neighbor's yard. However, fruit that falls naturally onto a neighboring property can generally be collected by the owner of that land.

In terms of maintenance, neighbors may remove overhanging branches after first requesting the tree owner to do so, whereas roots encroaching on a property can be cut without prior notice. While plants near boundaries can cause issues, such as attracting insects, the presence of pollinators like bees or wasps is typically not considered a legal violation unless it exceeds the 'average measure' of nuisance defined by local circumstances and property use.
