Polish property owners face limits on green belts and neighbor flooding

Owners of private land in Poland must verify the exact boundaries of their plots, as green belts (pas zieleni) adjoining roads are public property managed by road authorities. Under the Public Roads Act, any planting, placement of objects, or modification of the green belt requires a permit from the road manager; unauthorized work can result in fines up to ten times the standard daily fee.

Polish water law also protects landowners from neighbor‑induced flooding. Alterations that change drainage—such as raising ground level, installing impermeable driveways, or diverting runoff—are prohibited when they cause damage to adjacent plots. Affected owners can claim compensation, but must document the damage with photos, records and witnesses. Municipalities may order the responsible party to restore conditions or install preventative measures, and civil courts handle compensation claims.
