Polish Prosecutor Ends 'Two Towers' Fraud Probe Involving Jarosław Kaczyński

The Warsaw District Prosecutor's Office dismissed the criminal investigation into the so‑called “two towers” affair on 25 June, with the official justification issued on 23 July. The case examined accusations by Austrian businessman Gerald Birgfellner that Jarosław Kaczyński, president of the Law and Justice (PiS) party, acted as the decisive figure in the Srebrna company’s investment decisions for two skyscrapers in Warsaw. Prosecutors concluded that Kaczyński had no authority or duty to make such decisions and that Birgfellner’s belief was unfounded. The 63‑page justification notes that Birgfellner should have negotiated with the Srebrna board, not the PiS leader, and found no evidence of fraud or a “priest’s envelope” payment.

Birgfellner, who claims he was unpaid for 16 months of preparatory work amounting to €1.3 million, also alleged a €50,000 donation to a priest linked to the foundation overseeing Srebrna. His legal representative, former MP Roman Giertych, announced plans to appeal the prosecutor’s decision. The closure marks the end of one of the most publicised legal battles surrounding the planned Warsaw tower project, which had drawn extensive media attention since its reveal in 2019.
