Polish prosecutors face promotion stalemate over halted nominations

The independent prosecutors' association Lex Super Omnia has criticised the Justice Ministry for repeatedly withholding nominations to higher prosecutorial posts. On 29 June 2026 no appointments were made for adviser or first‑level prosecutor positions, prompting the association to call the situation "concerning" and to demand transparency about the reasons for the delays.

Lex Super Omnia argues that the lack of promotions weakens staffing across all levels of the prosecutor's offices, especially regional units, because prosecutors awaiting promotion are reassigned to higher courts, leaving their original offices short‑filled. The group is urging the Ministry of Justice and the Prosecutor General to explain the non‑transparent decision‑making and to process pending nomination requests.

The association stresses that while the Minister of Justice has the legal authority to make staffing decisions, citizens should be informed of the substantive grounds for appointments or refusals, and that the ongoing vacancy crisis hampers the work of the prosecution service.
