Drogasil fined R$ 10 million for requiring CPF for discounts

The Court of Justice of Maranhão (TJ-MA) has upheld a ruling condemning the pharmacy chain Drogasil to pay R$ 10 million in collective moral damages. The decision stems from the company's practice of requiring customers to provide their CPF or other personal data as a mandatory condition to access discounts and promotional offers.

Judges determined that conditioning commercial benefits on the provision of personal information is abusive, as it fails to guarantee freedom of choice and exerts financial pressure on consumers who wish to protect their privacy. The ruling emphasizes that refusing to provide a CPF should not result in a 'financial punishment' where customers must pay higher prices for the same products.

The court also prohibited the company from making such discounts conditional on data provision. Under the General Data Protection Law (LGPD), companies must ensure transparency regarding the purpose, necessity, and duration of data processing, ensuring that consent is free, informed, and unequivocal.
