The court emphasized that refusing to provide a CPF should not result in a ‘financial punishment’ where customers must pay higher prices for the same products. Under the General Data Protection Law (LGPD), the ruling notes that companies must ensure transparency regarding the purpose, necessity, and duration of data processing to ensure consent is free, informed, and unequivocal.
