Romania Constitutional Court to review new pension law

Romania's Constitutional Court has scheduled the first hearing to review the constitutionality of Law no. 360/2023, the new pension law that came into effect on September 1, 2024. The first court date is set for October 22, 2026, to address challenges regarding specific articles of the legislation.

Many retirees have expressed dissatisfaction with the new law, specifically citing concerns over the recalculation formula, deadlines for filing appeals, and the process for those in special work conditions or with disabilities.

Regarding eligibility, the law stipulates a full contributory period of 35 years for both men and women. However, individuals may request retirement up to five years before the standard age if they have exceeded the required contributory period by at least five years. In these cases, certain non-contributory periods or assimilated periods may be recognized toward the total requirement under specific legal conditions.
