Romania pension reforms and social benefit payments
Overview
The Romanian Senate has tacitly adopted a government draft law aimed at limiting the simultaneous receipt of a full pension and a full salary from state funds. Under the proposed regulations, beneficiaries of military or service pensions who choose to continue working within public institutions would face an 85% reduction in their pension amount. These restrictions are not applicable to retirees employed in the private sector. Government officials estimate that at least 15,000 employees are currently in such situations.
The bill passed the Senate after the deadline for debate and voting expired, moving the legislation to the Chamber of Deputies for further consideration. The draft law also allows public officials who have reached retirement age to request continued employment, with the possibility of receiving annual extensions up to age 70, pending approval from their respective institutional heads.
Following negotiations regarding potential exemptions, the current draft maintains specific protections for local elected officials and individuals holding mandates explicitly provided for in the Constitution, including members of Parliament, the President, and judges of the Constitutional Court. This legislative effort follows a 2023 rejection by the Constitutional Court of Romania, which cited concerns regarding arbitrary exceptions and inconsistent justification in previous attempts to implement similar measures.
