Romania: Drivers may request repeat breathalyzer tests
In Romania, drivers have the right to request a repeat breathalyzer test under specific conditions introduced to the Traffic Code in 2024. If an initial measurement indicates a blood alcohol content of no more than 0.10 mg/l of pure alcohol in exhaled air, the driver may request a second test.
The second test cannot be performed immediately; there must be an interval of at least 15 minutes and no more than 20 minutes between the first and second measurements. If the second test results in 0 mg/l, the driver may continue their journey without alcohol-related sanctions. However, if the second test also indicates the presence of alcohol, even below 0.10 mg/l, the driver may still face a fine. In such cases, the lowest value obtained from the two tests is recorded in the official report.
