Romania implements new urbanism code and property regulations

Under the new Urban Planning, Urbanism, and Construction Code (Law no. 169/2026), which took effect on August 25, 2026, property owners in Romania who have illegally enclosed balconies face a 100% increase in building taxes. This tax hike applies to unauthorized or unregularized structures and remains in effect until the owner obtains legal authorization or removes the unauthorized works. The increased tax applies to the entire apartment rather than just the balcony area.

Regulations distinguish between types of interventions. Enclosing a balcony with joinery may follow a simplified procedure involving notification to the local town hall. However, integrating a balcony into a living area, such as a living room, requires technical evaluations, structural expertise, and additional approvals due to potential structural changes.

Additionally, regulations regarding common areas in residential buildings emphasize that personal items, such as bicycles, must not obstruct hallways, stairs, or emergency exit routes. While placing a bicycle in a common area does not automatically trigger a fine, sanctions may apply if the object limits circulation or compromises safety and emergency evacuation access.
