Romanian property and urbanism regulations

Overview

Romania has established specific legal frameworks governing property ownership, urbanism, and building maintenance. Under the Urban Planning, Urbanism, and Construction Code (Law no. 169/2026), which became effective in August 2026, property owners face a 100% increase in building taxes if they have illegally enclosed balconies. For this to be implemented, local municipal councils must approve the measure, and city halls must first officially verify that the construction work was performed illegally. Owners of unauthorized modifications will have a maximum of one year to seek legal compliance. The code also mandates that personal items must not obstruct common areas like hallways or emergency exits.

Complementing these urbanism rules, Law no. 196/2018 and the Civil Code outline the obligations of apartment owners regarding the maintenance of shared building elements. Owners must contribute to the repair of common facilities, such as elevators, terraces, and shared water or gas installations, proportional to their ownership share. This obligation applies even if a resident does not directly use the facility; for example, ground-floor residents must still contribute to elevator repairs.

Regarding renovations, while minor maintenance typically does not require neighbor approval, significant structural modifications require legal documentation and may necessitate consent from neighbors or homeowners' associations to ensure building integrity, resident health, and safety.
