Romanian Constitutional Court delays SAFE program ruling

The Constitutional Court of Romania (CCR) has postponed its decision on a petition filed by Chamber of Deputies President Sorin Grindeanu concerning a possible constitutional conflict between Parliament and the Government over Emergency Ordinance No. 38/2026, which established the “Action for European Security” (SAFE) program. The court set a new hearing date for 15 July.

Grindeanu argues that the Government adopted and published the ordinance after a motion of no‑confidence ousted it on 5 May, thereby exceeding its authority to legislate and infringing the Constitution. The petition seeks a declaration of the conflict and measures to restore constitutional order. The CCR previously rejected a similar challenge brought by over 50 AUR deputies, SOS Romania, the PACE and unaffiliated MPs.

The case highlights tensions over executive powers during a parliamentary transition and could affect the implementation of the SAFE security initiative.
