Romanian Constitutional Court upholds SAFE emergency ordinance, unlocking €16.6 bn defense funding

The Constitutional Court of Romania debated a constitutional challenge to the emergency ordinance that implements the EU’s Action for the Security of Europe (SAFE) program. Over 50 deputies argued the law exceeded its scope, touching areas such as the National Recovery and Resilience Plan.

On 4 June 2026 the Court rejected the challenge, finding the ordinance constitutional. The decision was taken with 69 votes in favour, three against and 31 abstentions. The ruling confirms the legal basis for allocating roughly €16.68 billion to Romania for the purchase of military and dual‑use equipment and related infrastructure under the SAFE instrument.

The Court’s agenda also included a separate request to resolve a constitutional conflict between the Parliament and the Government concerning the same ordinance, scheduled for 10 June 2026.
