Romanian Constitutional Court postpones ruling on SAFE emergency ordinance

The Constitutional Court of Romania (CCR) announced on 10 June that it will defer its decision on a complaint filed by Sorin Grindeanu, President of the Chamber of Deputies and PSD leader, until 18 June. Grindeanu argues that the interim government of Ilie Bolojan issued Emergency Ordinance No. 38/2026 on the SAFE defence‑investment programme after the cabinet lost parliamentary confidence on 5 May, and that the ordinance was published in the Official Gazette on 8 May while the government was no longer authorised to adopt such measures. The complaint cites the addition of twelve new articles on the day of the confidence‑no‑confidence vote and claims the ordinance overlaps with legislation already under parliamentary debate, creating a constitutional conflict between the executive and Parliament. Bolojan rejected the accusations, labeling the challenge a political maneuver. The CCR’s postponement means the constitutional validity of the ordinance and the limits of an interim government’s powers will be examined in the upcoming June 18 hearing.
