Romanian Court of Appeal annuls Bolojan's decision to set up justice committee

The Bucharest Court of Appeal accepted a request from an NGO and annulled interim Prime Minister Ilie Bolojan’s decision (No. 574/19 Dec 2025) to create a Committee for the analysis and revision of justice legislation at Victoria Palace. The court suspended execution of the decision pending a definitive ruling, ordered the government to pay 120 lei in legal costs, and allowed the ruling to be appealed within 15 days.

The judgment follows a March ruling by the High Court of Cassation and Justice that had already suspended the committee, stating there was a “possible excess of power in the way the committee was constituted and operated” and raising serious doubts about compliance with the principles of legality and separation of powers. The committee, formed in December 2025, was to include permanent members from the Prime Minister’s Chancellery and the Ministry of Justice and was created after revelations in the documentary “Recorder – Justice Captured.” The case was brought by the Coalition for the Defense of the Rule of Law, led by lawyer Elena Radu.
