Philippines Senate debates conviction threshold in VP Sara Duterte impeachment
The Senate impeachment court is currently debating a critical constitutional question regarding the voting threshold required to convict Vice President Sara Duterte. The central dispute concerns whether the two-thirds requirement refers to the full 24-member Senate, which would necessitate 16 votes, or if the threshold should be adjusted due to the absence of several senator-judges.
Four senators are currently unable to regularly participate in the proceedings: Jinggoy Estrada and Rodante Marcoleta are detained in separate cases; Ronald “Bato” dela Rosa is absent amid an International Criminal Court arrest warrant; and Loren Legarda is on medical leave abroad. Senator Robinhood Padilla has called for rules to be adjusted to protect the rights of members to attend proceedings.
To provide legal guidance, four retired Supreme Court justices are serving as amici curiae. Retired Chief Justices Artemio Panganiban, Reynato Puno, and Hilario Davide Jr., along with retired Associate Justice Adolfo Azcuna, are offering independent legal views on the interpretation of the constitutional requirement. During the proceedings, Senator Pia Cayetano expressed concerns regarding the intense pressure and legal threats faced by senator-judges during the trial.
