Adding to the legal pressure, Senators Robin Padilla and Bong Go, alongside PDP-Laban, have filed a Petition for Certiorari and Prohibition. The petitioners seek to restore the 16-vote requirement, arguing the Constitution explicitly requires the concurrence of “two-thirds of all the Members of the Senate.” They contend that because no Senate seats have been vacated, the threshold must remain 16 regardless of whether individual senators are absent or ill.

As the legal dispute continues, Senate President Sherwin Gatchalian indicated that a revised trial calendar could potentially allow for a final vote by December.
