SEC shifts crypto strategy to target fraud and investor harm

The U.S. Securities and Exchange Commission (SEC) is shifting its cryptocurrency enforcement strategy to focus on intentional misconduct and actual investor harm rather than the total number of cases filed. During a recent podcast, SEC Chairman Paul Atkins and Enforcement Director David Woodcock emphasized the need for regulatory clarity, stating that companies should not have to learn rules through litigation.

Woodcock indicated that investigators will prioritize cases involving insider trading, accounting fraud, and compliance failures. Recent enforcement actions illustrate this direction, including lawsuits against Cryptoaiml Ltd. and Cryptoaiml Capital Foundation for allegedly stealing over $12.5 million, as well as actions against TSAI Pro Ltd. and TSAI Capital Foundation for the alleged theft of $2.8 million. In those instances, the SEC claimed the entities used WhatsApp and false promises of AI-driven trading bots to deceive investors.
