US SEC cryptocurrency regulatory strategy shift
Overview
The U.S. Securities and Exchange Commission (SEC) has undergone a significant change in its approach to cryptocurrency regulation and enforcement.
Initially, under interim leadership from Commissioner Mark Uyeda, the agency dismissed several civil enforcement actions against major industry players such as Coinbase, Ripple Labs, and Kraken. Uyeda characterized this as a “180-degree shift” intended to protect the agency’s credibility by avoiding legal positions that the commission intended to reverse through new rulemaking. During this period, the SEC also moved toward a rulemaking-focused model, implementing an “Innovation Exemption” to allow certain on-chain venues to trade tokenized U.S. stocks.
Following this, SEC Chairman Paul Atkins and Enforcement Director David Woodcock indicated a refined strategy that prioritizes targeting intentional misconduct and actual investor harm. Rather than focusing on the volume of cases, investigators are now prioritizing instances of insider trading, accounting fraud, and compliance failures. Recent enforcement actions under this direction include lawsuits against entities such as Cryptoaiml Ltd. and TSAI Pro Ltd. for the alleged theft of investor funds through deceptive practices.
