Serbia implements new ‘Do Not Call’ registry rules and fines
A new regulation regarding the ‘Do Not Call’ register has entered into force, mandating that traders check the registry before making any promotional or sales-related telephone calls. The rule is designed to protect consumers who wish to avoid unsolicited marketing messages and calls.
Failure to comply with this obligation carries significant financial penalties. Traders face fines of 200,000 dinars, while the responsible person within the company can be fined 50,000 dinars. Additionally, under the Law on Electronic Communications, direct advertising without prior consent can result in fines ranging from 500,000 to two million dinars. Vesna Perinčić of the Republic Union of Consumers noted that penalties can be applied repeatedly for each instance of non-compliance.
Registration in the ‘Do Not Call’ registry is free of charge. Citizens can request to be added to or removed from the list through their telecommunications operator via websites, mobile applications, or in person at service points. Upon submission, the user's identity is verified, and changes become effective the following day. Users can change their status once per calendar month, but once registered, the status remains valid unless a change is requested. This protection remains in place even if a user changes operators while keeping the same phone number.
