Tucumán court rejects Sergio Denis family indemnity claim
The Chamber in Contentious Administrative Matters of Tucumán has rejected an indemnity claim filed by the family of singer Sergio Denis. The court ruled that the singer's own actions were the direct cause of the 2019 accident at the Teatro Mercedes Sosa, which led to his death in 2020.
According to the ruling, Denis was walking backward on a walkway while performing and looking at the audience, failing to verify his path before falling into a three-meter-deep orchestra pit. The judges classified the incident as a “hecho de la víctima” (act of the victim) or “autopuesta en peligro” (self-endangerment), which broke the causal link required to hold the theater, the organizers (ATSA), or the State responsible.
As a result of the dismissal, the court also ordered the family to cover the legal costs of the proceedings. Bárbara Hoffmann, the singer's daughter, expressed her indignation on social media, describing the decision as “lamentable” and criticizing the judicial system for blaming the victim.
